On Friday Gingrich said: “I am not a citizen of the world. I am a citizen of the United States because only in the United States does citizenship start with our creator. [...] I think this is one of the most critical moments in American history. We are living in a period where we are surrounded by paganism.”

Have anybody explained to him that the church steeple, the bellowing bells and the very dogma of his American church have either an pagan origin or were substantially formed by pagans. He need not be afraid that the US is facing its final hours due to paganism.
As far as his fears in regard to homosexuality and abortion these are issues that have preceded paganism. He will need to seek the devil somewhere else!

South African National Credit Act

Today I would like to write about a subject close to my heart, i.e. Consumer Law and specifically the South African, National Credit Act, 2005.

This act has so much going for it. Unfortunately the facilitators of it has been, to say the least, arrogant in their approach by thinking that accountants new more about the law than the legal profession. They wanted to prescribe legal jurisprudence while not having the foggiest idea of what it entailed. Although they needed the courts to sanction debt restructuring, they thought it possible to replace attorneys with debt councillors.

The most important part of the act that creates the problems, is the part that relates to debt counselling and debt restructuring. Provision has been made for the appointment of debt councillors. As a pre-requisite these people have to complete a 5 day course (sic). 5 Days against 7 years of specialised training. With this training (it is argued) they should be able to formulate a debt restructuring plan which need to be taken to court on motion and naturally need to comply with the Magistrates’ Court Act and Rules.

Now they find that their debt councillors and their phony presumptions in regard to jurisprudence are torn apart in court. They refuse to accept that rules have been developed over hundreds of years to protect the rights of litigating parties and to ensure a fair and reasonable outcome for all. Less than 3% of all debt restructuring applications are successful! In a state of anxiety the National Credit Regulator has approached the High Court for a statement of sympathy and a declaration that these matters be treated as quasi-administrative functions by magistrates. Again their approach is not to draw the legal fraternity in to assist but to sideline them and negate any influence they might have on the protection of the statutory and common law rights of creditors.

Down the grapevine it is also understood that instructions have been given to certain council for legal opinion and advise on amending the act to give affect to the misplaced vision of the facilitators. One can only expect that amendments will contemplate methods of circumventing normal legal process and the legal professions.

It is time that the NCR understood that they should abandon all their fancy footwork and trying to be a law unto themselves. Concentrate on using existing jurisprudence and the goodwill of the legal professions to secure their aims. The act as it stands, can work with a few minor amendments. But let lawyers consider the questions of jurisdiction, notice, etc.

Abortion madness

Abortion is a highly emotional issue and should naturally be treated with the greatest of caution. With the murder of a well-known pro-abortionist at a church in the US very strange comments were published. I for instance read one Catholic lady writing that she could understand everything. She could however not understand what he was doing at a church. Looking at the history of the Catholic church and the way it brutalized millions of people, I find it rather difficult to understand her moral stance.

Obama and Israel/Pakistan

The pressure on pres Obama for not taking sides with Israel has reference.

Israel is the point on Earth where three of the biggest religion, i.e. Christianity, Islam and Judaism meet. One would expect that it would be the most holiest place on the planet - a place where the love and compassion for each other, forming the basis of these dogmas, would come to fruition. Instead it is a most unholy center of hate.
For this reason I do support Mr Obama. It’s time that these people understood that we are fed-up with their fighting and that they should get positively involved in seeking a bona fide solution. Their dispute lays at the heart of the terrorist threat the world is facing in the region stretching from Iran right through to Pakistan.

A CIRCLE OF FRIENDS

Something that fascinates me is the concept of a brotherhood, i.e. people bound together by loyalty or a pledge of commitment, helping and supporting each other.

We all need work to earn a living, get contracts to do work and aspire to go ahead in live. Some of us need wide support to gain office or combat injustice, promote a cause, etc., etc. A wide circle of evenly minded, loyal friends is what you and I then need. A sincere pledge of loyalty and commitment amongst us to be real and true friends need to form the basis of such a relationship.

Just think: You lost your job and need to find another. You can call on your friends to help. Or you are dependent on programming contracts and you know that your friends will channel your way whatever is available, etc.

We all have sincere empathy with people who suffer depravation and human indignity due to political crimes. But until now many of us did not have any idea of what they are going through. We are now getting a taste of it. Loosing our jobs, our houses, our livelihood – looking in the eyes of our children and telling them that we have failed – man, that’s hard!

With facilities like Twitter, Facebook and Friendfeed available it becomes so much easier to set up such a network of friends and to gain new ideas and contributions to a worthwhile idea. Let’s see what we can do. Please respond via comments on this blog.

We live in a highly materialistic world. Only physical, touchable things exist and have value. Goodies. A few still feels a bit religious but even they are doubting the value and truth of what organised religion has to offer them. For the rest, well, we have killed dreams, fantasy, the faeries, the spirits and the ghosts. All we are left with is things. When we close our eyes there is nothing. It’s empty inside. We are dead. Without our things Life has no purpose. Now the global economic mess is even taking away our things. Man, this is the poorest humanity has ever been!

THE ILLUSION OF WEALTH

Expressions like “credit crunch”, “toxic debt”, etc have become commonly used over the last few weeks. The banks and financiers are being held liable for the fact that the bubble has burst and that the house of cards came tumbling down. Suddenly our consumerist society can no longer function. Inexplicably banks suddenly have been stripped of their assets and need to be ‘re-capitalized’ before they would be able to function again. What happened? Was there an alien invasion that stripped them of all their funds?

No. The fact of the matter is that all this riches and money never really existed in the first place. Our prosperity was as virtual as the computer world itself! Politicians and financiers would like you to believe that the problem is one of credibility and trust. With this they are still trying to keep up the charade. ‘This fantasy world in which you live where you do not need to work to be rich – where you can spend without limitation what you have not earned – this world is real. You just need to believe in it!’

The true situation is that this was all make-believe. All this phantom was a pie in the sky. All this riches never existed, neither in private hands nor in banks.

And how are we going to fix it? Are we going to try and re-create this silicon world or are we going to start from scratch? This is the scary part: With the so-called bailout and rescue packages announced by governments over the past few days they now plan to collect money from you and every other poor bastard on Earth to try and make the fantasy true! By taking life energy from all of us and injecting it in this image, they want to keep up this hologram. You’re asked to participate in this séance in which we will all let the dead rise from the grave. The idea is to take money from all of us and to pump it into these deflated banks!

No. We should realize that we have reached the end of an era. The days when million became billions and grew into trillions; when monetary value was created by expectation and not by value and hard work; when you could earn a $1000 but spend $100 000 with little or no security; when thousands of uneducated and very stupid people were made monopoly millionaires over-night – those days have gone for ever!

To all these bankers and get-rich-quick millionaires I say: Welcome to the real world!

Start the African Renaissance without me

For some or other reason someone posted a letter on Muti today which was written and published as far back as 12 April 2007. This open letter addressed to Thabo Mbeki under the title Dear Mr President …” was written by Brian Chikwava and deals with the Zimbabwean crisis and the proposed manner in which Thabo Mbeki should deal with it. The letter starts off with the following:

“Dear Mr President ….There are clamours from all corners of the Earth asking you to do their bidding on the Zimbabwean question. I do not agree with that on principle. Although I am not in the habit of writing letters, I am worried that events north of the Limpopo may soon leave you with few comrades to count on.

South Africa’s own path to democracy is instructive. Today, from the Republic of South Africa we have witnessed the birth of the African Renaissance, which now roars up in the sky like the sun, sending freedom and great tidings to the weary bones of the inhabitants of the continent of Africa.

I agree that Zimbabwe’s problems should be solved by the people of Zimbabwe. A cursory glance at history will reveal that, in their struggle for democracy, South Africans went about their business quietly. They never bawled for outside help in the way Zimbabweans are doing. They never moralised to the world about the conditions in their country. They did it all by themselves.”


Maybe it is good that the contents of this letter be evaluated now, almost a year after being written. Maybe we may learn something of the unfathomable intellect of
Africa.


He firstly refers to
South Africa and the birth of the ‘African Renaissance’. He says it “roars up in the sky like the sun, sending freedom and great tidings to the weary bones” of Africa. With a ‘renaissance’ I presume that he refers to an age of enlightenment which follows on some medieval, dark age as occurred in Europe a few centuries ago. As I am not aware of any development, I’m afraid that the writer will have to provide more information about this roar into the sky”, what ‘new found freedom’ he refers to. The ‘tidings’ he speaks of have also not reached our ears.


I must confess towards Mr Chikwava that all I see is the
DRC, Kenya, Zambia, Somalia, Ethiopia, Sudan, Chad, Ivory Coast, Mauritania, Equatorial Africa and even Nigeria. No renaissance is taking place in these places that I know of. Maybe he refers to Botswana, the AIDS ridden country that is the only light in Africa. Even in South Africa everything indicates that the Western concept of a democracy based on the Rule of Law is on a downward slope and that your concept of freedom is taking over.


It is obvious from the letter that Brian Chikwava is a staunch supporter of Robert Mugabe. He says

“The entire population of Zimbabwe was liberated by Comrade Robert Mugabe, a great son of Africa. But since then they have forgotten themselves. On close examination, we can see Zimbabweans misbehaving, throwing their tails about, employing all the force of their ballot boxes to evict the great liberator from office.”


The ‘entire population’ referred to presumably does not include the whites as they were disowned and chased out of the country. I also presume that it does not include the almost 100 000 Mathabeles, murdered on instruction of this great liberator. It would further seem to exclude those ignorant members of the population who see freedom and liberation as something that culminates in democracy and the exercise of the vote at the ballot box. Can you believe the audacity of these people using the ballot box to remove this great liberator from office?!


I would agree that one should ignore the demands of those bastards in the West. The problem I however foresee is that we’ll have serious problems without the US$300 billion aid on which we depend. You know, on top of the US$ 300 billion our ‘liberators’ dispossess from their populations, it is rather a substantial amount to do without. We need money to buy bullets so that we can effectively intimidate the demonstrators.


So, under the circumstances, I do understand that you are satisfied with the way in which Mbeki has handled the matter. Your liberator can go on doing what African liberators do best whilst Mbeki keeps the West satisfied and the money rolling in.


Before closing off I would like to share with Mr Chikwava one piece of personal wisdom. You know, life has certain rules. In trade, for instance, if you want to make profit from selling bananas, you must sell it for more than you paid for it. In your price you must also provide for those losses due to bananas getting bad. Simple rules. If you want to make more profit, you can’t just raise the price because you are then going to be more expensive than your competitor. You must buy more, start new distribution points, train people to sell for you – keep them from stealing from you, etc.


Now, western economics, liberation, freedom and democracy – all these concepts have their specific principles to be followed. You do not kill a man and say that he has been liberated. In the West that is not liberation. It’s murder or, as in Mugabe’s instance, a crime against humanity. No, you give him a ballot paper and a ballot box and you tell him to vote for the person that he wishes to govern him in accordance with the Constitution. You tell him that if, by any chance his candidate is not finally chosen by all, he should accept the choice of the majority. He must not start killing those who voted for the winner. That is how things work. If it does not work like this it may be something peculiar with an African name. It is however not freedom and democracy.


Finally and in regard to the renaissance, I wish to add, The day you and your bro’s accept these basic principles I explained to you – that day will be the first day of the African Renaissance!
